Chyna Design: Terms

Before proceeding with an order you will be required to show that you have read and understood the following terms and conditions. We recommend that you print a copy of these Terms and Conditions for your future reference.

Please read this document carefully as it contains the Terms and Conditions that you agree to be bound by if you continue to use the e-shop “Chyna Design”.

Please note that these Terms and Conditions also incorporate the following sections which we advise that you read.

1. Ownership

1.1. This site is owned and operated by “Chyna Design”, registered office 19 Dove Rise Oadby, Leicester, LE2 4NY.

1.2. All rights in this website are owned by us. Any unauthorized use, copying or modification is prohibited.

1.3. “Chyna Design” reserves the right to alter these e-shop Terms from time to time.

2. Acceptance of orders

2.1. All orders placed through our e-shop will be subject to our acceptance of the order.

2.2. When you submit an order to us on our e-shop you will receive an email from us acknowledging your order and giving you estimated timescales for delivery. You should check emails for accuracy and let us know immediately if there are any errors. Neither of these emails constitute acceptance of the order by us.

2.3. If e-shop products become temporarily unavailable, we shall hold your order until we have the product back in stock and will then mail the product to you in the usual way. In the event that an individual product becomes permanently unavailable then we will seek to offer you a suitable alternative or give you a full refund.

2.4. Should you wish to cancel your order or return any goods, please go to the “Cancellation/Returns Policy” section for further information.

3. Products, Pricing and Payment

3.1. All product prices exclude Value Added Tax (“VAT”) where applicable.

3.2. We reserve the right to amend any prices without any prior notice and at any time and the right to add or withdraw any product at any time.

3.3. Whilst it is our intention to keep our e-shop up to date and error free, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.

3.4. “Chyna Design” has made every effort to reproduce colours in the e-shop as accurately as possible. However, different computers reproduce colours in slightly different ways, and so exact colour matches are not yet possible over the internet. This means that when you order products from the e-shop, colours may differ from what you see on the screen. If you are not satisfied with the colour of the product you have ordered, we operate a returns policy. Please go to the “Cancellation/Returns Policy” section for further information.

3.5. We accept Cheques drawn in £ (Sterling) from UK residents, by debit card and Bank Transfers only.

3.6. Items must be paid for within 3 days of online purchase, otherwise it will be deleted.

4. Delivery

4.1. Your order will normally be dispatched within 48 (forty eight) hours of placing the order. Whilst we make every effort to deliver goods within such timescales, however, some delays are inevitable. We shall not be liable for any delay that you may suffer in this regard.

4.2. We can only send orders to street addresses in the United Kingdom. We do not deliver to a PO Box address.

4.3. Some postal addresses in Northern Ireland, some offshore islands and some remote areas of Great Britain may not be covered by our delivery services and we may not be able to arrange delivery of some items to such addresses. You will be notified of this when you place your order.

4.4. Whilst we make every effort to deliver goods on the day we specify, we cannot guarantee delivery on that day or accept liability for deliveries made outside this timescale. We cannot accept liability for out of pocket expenses or other costs incurred due to failed or delayed deliveries.

4.5. All items are subject to stock availability.

4.6. Please note that if you wish to return goods, you have 3 (three) working days from receipt of the goods to return them to us. Please go to the “Cancellation/Returns Policy” section for further information.

4.7. If an item is faulty please contact us and we will arrange an appropriate remedy.

5. Cancellation/Returns Policy

5.1. We have the right to cancel any order you make for any product if you fail our validation or security checks. If payment has been taken you will receive a full refund and an e-mail confirmation confirming such refund to the e-mail address you provide in your registration form.

5.2. You have the right to cancel any order you make for any product purchased through the online store and you will receive a full refund (except post charges). If for any reason you are not satisfied with your purchase, Return it to us within 3 (three) working days of receipt in an unworn/unused condition for a full refund or exchange. When returning products to us for refund or exchange, you must pay for the appropriate postage costs. If a full refund is applicable or the exchange has been caused by an error on our part then we will refund the postage you have paid on receipt of the returned product.

5.3. Should you wish to return or exchange a product bought from the e-shop “Chyna Design”, please first send an e-mail (“Contact” section), with the Subject “Return request- Order No” (The order number shown on the front of this delivery note) and the details for the items you wish to return before return the products.

5.4. Our liability for any claim for loss or damage shall be limited to the sum paid by you for the goods.

6. Privacy Policy

6.1. We take your privacy and the security of your personal information very seriously and are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).

6.2. If you wish to check the information that we hold about you, please e-mail us. If you find any inaccuracies we will delete or correct it promptly.

6.3. We will never give or sell your information to any other company or organization. We do not send random marketing emails to personal email addresses (spam).

6.4. We will never load a "cookie" on your computer.

7. Government Advice on Internet Shopping

The use of our site and any contracts formed are governed by English law (“Distance Selling”).

8. Law and Jurisdiction

8.1. Your agreement with us is subject to English and Welsh law and jurisdiction.

8.2. The laws of the United Kingdom govern all purchases made via this web site.

9. Your Rights

The above terms do not affect your statutory rights.

10. Third Party Rights

The Online Store Terms are not intended to give rise to any right which is enforceable by a third party by virtue of the Contracts (Rights of Third Parties) Act 1999.
